Welcome to All Feathers Taxidermy (“All Feathers”). The terms “we”, “us” and “our” refer to All Feathers. We operate this website and online store, including all related information, content, features, tools, products and services (collectively, the “Services”), to provide you with access to and purchase of our digital products. Our store is powered by Shopify, which enables us to provide the Services to you.

These terms and conditions, together with any policies referenced herein (these “Terms of Service” or “Terms”), describe your rights and responsibilities when you use the Services.

Please read these Terms carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.

By visiting, interacting with, or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you should not use or access our Services.

By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence, and you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase, or manage.

To use the Services, including browsing the store or purchasing digital products, you may be asked to provide certain information, such as your email address and billing/payment information. You represent and warrant that all information you provide is correct, current, and complete and that you have all rights necessary to provide such information.

You are solely responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You may not transfer, sell, assign, or license your account to any other person.

SECTION 2 - OUR PRODUCTS (DIGITAL CONTENT)

All Feathers offers digital products, including but not limited to video tutorials, instructional content, and related downloadable or streaming materials (“Digital Products”).

We make reasonable efforts to accurately describe and display our Digital Products. However, we do not guarantee that product descriptions, examples, outcomes, or results will meet your expectations.

All descriptions of products are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and may limit the quantities of any products that we offer to any person, geographic region, or jurisdiction.

SECTION 3 - ORDERS

When you place an order, you are making an offer to purchase. We reserve the right to accept or decline your order for any reason at our discretion. Your order is not accepted until we confirm acceptance and successfully process payment.

Please review your order carefully before submitting, as we may be unable to accommodate cancellation requests after an order is accepted and access to Digital Products is delivered.

Refunds/Returns: Your purchases are subject to our Refund Policy. For clarity, Digital Products are non-returnable and non-refundable except as expressly stated in our Refund Policy (for example, to correct access issues or incorrect product delivery).

You represent and warrant that your purchases are for your own personal use and not for commercial resale, redistribution, or export.

SECTION 4 - PRICES AND BILLING

Prices, discounts, and promotions are subject to change without notice. The price charged will be the price in effect at the time the order is placed and will be set out in your order confirmation.

Unless otherwise expressly stated, posted prices do not include taxes. Because we do not ship physical products, shipping, handling, customs, or import charges do not apply.

You agree to provide current, complete, and accurate purchase, payment, and account information for all purchases. You agree to promptly update your account information so we can complete transactions and contact you as needed.

You represent and warrant that (i) the payment information you provide is true, correct, and complete, (ii) you are duly authorized to use the payment method, (iii) charges incurred will be honored by your payment provider, and (iv) you will pay charges incurred at the posted prices, including all applicable taxes, if any.

SECTION 5 - DELIVERY OF DIGITAL PRODUCTS (NO SHIPPING)

All Feathers does not ship physical products. All purchases are delivered digitally (for example, via online access, customer account, email delivery, download link, or streaming access).

Delivery timing may vary due to factors including payment verification and technical issues. You are responsible for providing an accurate email address and maintaining access to the email/account used to purchase.

SECTION 6 - INTELLECTUAL PROPERTY; DIGITAL PRODUCT LICENSE

Our Services (including all trademarks, brands, text, images, video, audio, and the design and arrangement thereof) are owned by All Feathers or its licensors and are protected by U.S. and foreign intellectual property laws.

License to you: Subject to these Terms, when you purchase a Digital Product, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Digital Product for your personal, non-commercial use only.

Restrictions: You must not reproduce, distribute, share, resell, rent, lease, publicly display, publicly perform, republish, upload, post, transmit, or create derivative works from any Digital Product, in whole or in part, without our prior written consent. This includes sharing login credentials, download links, files, or screen recordings.

Unauthorized use may violate intellectual property laws and may result in termination of access without refund and/or legal action.

All rights not expressly granted are reserved.

SECTION 7 - OPTIONAL TOOLS

You may be provided with access to customer tools offered by third parties as part of the Services. We do not monitor or control such tools.

You acknowledge and agree that we provide access to such tools “as is” and “as available” without warranties, representations, or conditions of any kind and without endorsement. We are not liable for your use of optional third-party tools.

We may also offer new features through the Services in the future. Such features are also subject to these Terms.

SECTION 8 - THIRD-PARTY LINKS

The Services may contain materials and links to third-party websites or functionality. We are not responsible for examining or evaluating the content or accuracy of third-party materials or websites. If you choose to access them, you do so at your own risk.

We are not liable for harm or damages related to your access or use of third-party websites, products, services, or content. Please review the third party’s policies before engaging in any transaction.

SECTION 9 - RELATIONSHIP WITH SHOPIFY

All Feathers Taxidermy is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with All Feathers Taxidermy. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and All Feathers Taxidermy, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with All Feathers Taxidermy.

SECTION 10 - PRIVACY POLICY

All personal information we collect through the Services is subject to our Privacy Policy. Certain personal information may also be subject to Shopify’s Privacy Policy. By using the Services, you acknowledge you have read these policies.

Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services. You represent and warrant that you own or have all necessary rights to the Feedback and that it complies with these Terms. We have no obligation to keep Feedback confidential, pay compensation, or respond.

We may remove Feedback at our discretion if it violates these Terms or is otherwise objectionable.

Occasionally, there may be information that contains typographical errors, inaccuracies, or omissions related to product descriptions, pricing, promotions, offers, and availability. We reserve the right to correct errors and to change or update information or cancel orders if any information is inaccurate at any time without prior notice (including after you submit an order).

You may access and use the Services for lawful purposes only. You may not use the Services to:

  • infringe our intellectual property rights or others’ rights;

  • share, resell, redistribute, or commercially exploit any Digital Product;

  • share access credentials or links to Digital Products;

  • upload malicious code; or

  • scrape or crawl the Services.

We may suspend or terminate access without notice if we determine you violated these Terms.

SECTION 14 - TERMINATION

We may terminate this agreement or your access to the Services (or any part thereof) in our sole discretion at any time without notice, and you remain liable for all amounts due up to and including the date of termination.

The following sections survive termination: Intellectual Property; Feedback; Termination; Disclaimer of Warranties; Limitation of Liability; Indemnification; Severability; Waiver; Entire Agreement; Assignment; Governing Law; Privacy Policy; and any other provisions that by their nature should survive.

SECTION 15 - DISCLAIMER OF WARRANTIES

The Services and all products offered through the Services are provided “as is” and “as available” without warranties of any kind, either express or implied, including implied warranties of merchantability, fitness for a particular purpose, durability, title, and non-infringement.

We do not guarantee uninterrupted, timely, secure, or error-free operation. Some jurisdictions do not allow the exclusion of certain warranties, so some exclusions may not apply to you.

SECTION 16 - LIMITATION OF LIABILITY

To the fullest extent permitted by law, in no case shall All Feathers, our partners, directors, officers, employees, affiliates, agents, contractors, service providers, licensors, or Shopify and its affiliates be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including lost profits, lost revenue, lost savings, loss of data, replacement costs, or similar damages, arising from your use of the Services or any products procured using the Services, even if advised of the possibility.

You agree to indemnify, defend, and hold harmless All Feathers, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, or claims (including reasonable attorneys’ fees) arising out of: (1) your breach of these Terms; (2) your violation of any law or the rights of a third party; or (3) your access to and use of the Services.

SECTION 18 - SEVERABILITY

If any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision will be enforceable to the fullest extent permitted by law, and the unenforceable portion will be severed without affecting the validity of remaining provisions.

SECTION 19 - WAIVER; ENTIRE AGREEMENT

Our failure to enforce any right or provision is not a waiver. These Terms and any policies posted by us constitute the entire agreement between you and us and supersede prior agreements or communications.

Ambiguities will not be construed against the drafting party.

You may not transfer or assign these Terms without our prior written consent. We may assign these Terms without notice.

SECTION 21 - GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws and courts in the jurisdiction where All Feathers is headquartered. You consent to venue and personal jurisdiction in such courts.

Headings are for convenience only and do not affect interpretation.

SECTION 23 - CHANGES TO TERMS OF SERVICE

We reserve the right to update these Terms at any time by posting changes on this page. It is your responsibility to review these Terms periodically. If required by law, we will notify you of material changes, which will be effective on the date specified in the notice. Continued use constitutes acceptance.
